Non-economic damages, disabled man with crutch
What are non-economic damages?

Economic damages cover the concrete, measurable costs of your injury, while non-economic damages compensate for the less visible negative effects that come after an injury.  Even though non-economic damages can be harder to measure, they're still real and significant.

Non-economic damages consider the personal suffering and emotional impact of an injury.

Pain and Suffering

This pertains to the physical pain and suffering that result from your injury. These damages are based on:

  • The severity and nature of your pain

  • The potential for life-long pain

  • How the pain affects your daily life

  • If the pain prevents you from performing daily functions

  • Whether injury has caused the loss of a limb

  • If the injury prevents you from enjoying hobbies

  • If the injury prevents you from participating in activities with friends or family

  • If the injury affects the time you spend with your children

Emotional Distress

Significant injuries can lead to psychological impacts like anxiety, depression, or PTSD.  Emotional distress damages compensate for this psychological toll.  Consider factors like the intensity and duration of your emotional suffering.

Loss of Enjoyment of Life

If your injury stops you from doing things you love like hobbies, sports, spending time with family, or even walks in the park, then you have suffered a loss of enjoyment of life.  A jury can award compensation for any loss of enjoyment of life caused by your injuries.

Loss of Consortium

In some cases, if a person is injured, their spouse can receive compensation for lost marital benefits, like companionship, support, affection, and intimacy. This is called loss of consortium.

Loss of Companionship and Society

In cases where someone is killed as a result of the negligent or wrongful conduct of another party, their family can seek money for the emotional suffering and loss of their loved one's companionshi and support.
